§ 12-1-1. Violations.

  • (a)

    Criminal violations. It shall be unlawful for any person to do any act which has been prohibited; declared to be unlawful; declared to be an offense; or declared to be a misdemeanor by any ordinance enacted by the Greenwood County Council or for any person to fail to perform any action affirmatively required by any ordinance enacted by the Greenwood County Council.

    (b)

    Infractions. To the extent that any ordinance referenced in subsection 12-1-1(a) created a criminal offense in violation of Article VIII Section 14 of the Constitution of South Carolina, the ordinance is hereby amended to create an infraction and to declare the conduct described therein a public nuisance in accordance with the opinion of the South Carolina Supreme Court in Foothills Brewing Concern Inc. v. City of Greenville 377 S.C. 154, 480 S.E.2d 718 (2008).

    (c)

    Future ordinances. Any ordinance adopted after the effective date of the ordinance from which this title is derived which contains substantially the terms: "It shall be an offense punishable as provided in title 12 of the Greenwood County Code," shall create a criminal violation, to the extent allowed by Article VIII Section 14 of the Constitution of South Carolina, and otherwise, shall create an infraction, each to be punished, respectively, as set forth herein.
